The Fillmore Planning Commission voted 5-0 to recommend City Council approve Zoning Ordinance Amendment ZOA 25-03 (Ordinance 25-987) to implement portions of the 2021'129 housing element, including a housing overlay zone for six parcels and a CEQA exemption for the change. Planning staff told the commission the amendment adds a housing overlay (HO) on six identified parcels, increases allowed residential density in that overlay and, at HCD's request, adds a footnote making clear that developments in the overlay that provide at least 20% of units as affordable are 'by-right' under the government-code definition. Why it matters: the by-right language means that qualifying multifamily development with at least 20% affordability is ministerial and cannot be conditioned by discretionary use permits, although the Subdivision Map Act still applies to any proposed subdivisions. Staff said HCD requested the explicit language; staff also inserted a minimum density in the table to match HCD's expectations. If the city does not finalize its housing element certification and implementing zoning, the city risks developer use of the state 'builder's remedy. During discussion commissioners asked how long affordable units must remain restricted; staff said affordability terms are recorded on title and differ by program (long-term restrictions such as multiple decades are typical). Planning staff said the amendment will be forwarded to council for readings and then returned to HCD for final certification of the housing element. The motion recommending council approval passed unanimously, 5-0.
