Resident seeks to add beach sand at 71 Kendall Pond East; DEP determination pending

Staff said they will wait for a final determination from the Department of Environmental Protection (DEP) on whether the activity qualifies as a lesser category filing or a category 2 Notice of Intent; staff described the standard setback approach the applicant proposed — an approximate 25‑by‑15 foot area with an 18‑inch setback from the water and use of masonry sand. The commission agreed to provide the property owner with an information packet and to await DEP guidance before taking further action. No permit decision was made; the item was treated as new business and will be updated after the commission receives DEP’s ruling. Staff said they will also consider preparing a webpage with instructions for waterfront owners about permit processes.
