Justin (staff member) said the commission and its agent exchanged materials with the proponent and that state agencies have increased enforcement attention. "The agent and the commission were forwarded the materials that were issued to the proponent of the dam structure," Justin said. He also reported that a state dam-safety authority is making the structure a priority for investigation.
Commission discussion focused on public-safety risk, lapses in prior compliance, and uncertainty over whether the previous owner still held responsibility. One commissioner said reports warned a catastrophic failure could threaten people downstream. Commissioners asked staff to contact state Dam Safety, the Department of Environmental Protection, and the city solicitor for direction on next steps and whether the commission should close its enforcement order while state agencies act.
The commission agreed to continue the enforcement matter to the October 27 meeting and to coordinate outreach: Justin will contact Dam Safety and DEP and provide materials to the city solicitor; the chair said he would copy the solicitor on correspondence.
No repair plan or binding schedule was adopted at the meeting. Commissioners noted multiple prior requests to the property owner had not produced remediation and said the commission needs clarity on legal responsibility before taking further unilateral action.
