The commission’s action followed a staff presentation that said the proposed encroachment is less than the 25% of the buffer area that the Fairview development code allows for construction activity. Alex, planning staff, said the buffer on properties abutting Fairview Lake is now measured at 50 feet from the top of bank and that the subject property’s total buffer area is “just over 4,000 square feet,” with the proposed encroachment of 552 square feet equaling approximately 13.8% of that area.
