The Fairview Planning Commission voted to recommend that the City Council adopt ordinance 03‑2025, a text amendment to remove minimum off‑street parking requirements from the Fairview Municipal Code and the comprehensive plan.
Alex Lopez, planning staff, summarized the proposal as the final phase of implementing Oregon’s Climate Friendly and Equitable Communities (CFEC) rulemaking and told the commission the staff recommendation was to remove parking minimums citywide. Lopez said the change would also remove scattered references to parking minima within the code and the comprehensive plan and that the Oregon Department of Land Conservation and Development (DLCD) had reviewed the amendments and offered no objection.
Lopez told the commission the city had already implemented earlier CFEC measures and that staff and the council found the first option presented in state guidance — repeal of parking minima — preferable to the other alternatives, which staff said would impose substantial administrative burdens. He said developers in Fairview are likely to provide market‑driven parking where demand exists and noted that a large portion of the city is already subject to more flexible parking rules.
Under the draft amendments, the code’s Chapter 19.164 (Vehicle and Bicycle Parking) would be revised to remove minimum parking requirements while retaining parking maximums and standards for parking lot dimensions and design. The comprehensive plan references to off‑street parking would also be removed to avoid creating an impression of a local minimum standard where none would remain.
No members of the public testified in opposition or in favor at the hearing, and Lopez said the city received no written testimony by the noon deadline; DLCD submitted a review comment and Metro provided no comment. After closing public testimony, the commission moved to recommend adoption of ordinance 03‑2025 and approved the motion by roll call.
The Planning Commission’s recommendation will go to the City Council for final consideration. If the council repeals the parking minima, Fairview will no longer be subject to the CFEC provisions that apply when a jurisdiction retains minimum off‑street parking standards and would instead implement the simpler path specified in state rule.
