The Kingman City Council voted Sept. 2 to repeal a July 16, 2024 development agreement and approve a new development agreement with High Desert Land Holdings LLC, plus a property escrow trust agreement with Pioneer Title Agency, to secure reimbursement for construction of Kingman Crossing Boulevard.
Staff said the new agreement replaces an earlier agreement that could not be fully executed by the applicant because of outstanding arrangements with adjoining property owners. Jason (staff member) told the council the new agreement has been fully executed by the applicant in advance of the meeting and moves construction of the boulevard up into Phase G of the Kingman Crossing subdivision. “The rephrasing allows for the proposed construction to take place and be completed no later than 06/30/2027,” Jason said, noting the change will help complete the circulation network for the area and reduce redesign for future phases.
The new agreement uses funds already included in the city’s capital improvement budget. Councilor Savage asked whether the $300,000 is simply being moved from the prior agreement to the new trust; Jason confirmed the $300,000 had been set aside in the capital improvement budget and is being transferred to the new trust arrangement. Staff recommended approval; the council adopted Resolution No. 5569 by voice vote.
Why it matters: the change accelerates the developer’s obligation to construct Kingman Crossing Boulevard earlier in the subdivision phasing and establishes a trust to secure the city’s reimbursement payment. The agreement cites compliance with requirements in Arizona Revised Statutes and the city’s municipal code for development agreements.
Action: motion to approve Resolution No. 5569 carried by voice vote. The agreement requires construction to be completed and accepted by the city no later than June 30, 2027.
