The Kane County Development Committee on Aug. 19 approved a minor subdivision adjustment in the Mill Creek planned-unit development that will permit a homeowner to construct a swimming pool and surrounding deck closer to the rear property line than zoning normally allows, provided the new decking is pervious. Planning staff said the PUD has relatively shallow rear yards in this section and that the house already uses the maximum typical lot coverage. Staff noted the standard pool setback is 20 feet and the required decking setback is 10 feet; the requested adjustment would allow an 11-foot setback for the pool and a 7-foot decking setback. The applicant agreed to use permeable materials for any new decking so the new impervious area would be treated as pervious in stormwater accounting. “Any additional impervious area must be considered pervious, and they’ve agreed to install any new decking around the new pool to be a pervious material,” planning staff said. The planner said neighbors within 250 feet were notified and no objections were received; staff said the planner had asked the owner to obtain neighbor letters and reported neighbors verbally indicated no issues. A motion to approve the adjustment was moved and seconded; roll-call votes recorded approval and the adjustment will proceed subject to the condition that new decking uses pervious construction and applicable subdivision-code provisions.
