Council members passed an ordinance on Aug. 14 amending Article 40, Plan Development designation PD 1144, to revise rear lot setback requirements for Zone 2 so the approved Orchard Place Apartments site plan matches the code. Staff presented the change as a correction to an oversight in the ordinance language adopted in April 2025.
Staff member Sydney said the originally approved ordinance showed a 50-foot rear setback for Zone 2, but the approved site plan places the building 12 feet from that lot line; staff recommended changing the ordinance to a 10-foot rear setback so the site plan is in compliance with city code. The Planning Commission held a public hearing Aug. 6 and recommended approval by a 5–0 vote with no public comments.
Council Member Bergman moved to pass the ordinance and to waive the second reading; Council Member Doreen Hebert seconded. The council indicated unanimous approval by voice, and the mayor declared the item carried. No amendments or additional conditions were added at the meeting.
The site is located at the northwest corner of 150th Street West and English Avenue and is the approved location for the Orchard Place Apartments project; the building permit and site plan had already been authorized in April. Staff said the text amendment is intended to align the written ordinance with the previously approved plans in order to ensure regulatory compliance.
