Apple Valley, Minn. — The City Council held a public hearing Aug. 28 on a request to vacate drainage and utility easements along the common lot line of Lots 1 and 2, Block 3, of the original Village of Founders Circle plat, and then deferred formal action pending submittal of a final plat.
City staff said the request accompanies a pending final plat to combine the two lots into a single parcel for a proposed “pickle hall” development. The applicant asked for an extension to finalize site-plan changes. Staff recommended the council accept public input at the hearing, close the hearing, but postpone acting on the easement vacation until the final plat returns to the council — at which time replacement easements will be dedicated on the new plat if required.
"The request tonight is to vacate the existing drainage utility easements on Lot 1 and 2 of Block 3 of the original Village Of Founders Circle plat," staff said during the presentation. A council question about statutory time frames for deciding the matter drew a reply from city counsel that there was no specific time frame applicable to this item.
No members of the public spoke at the hearing. The council closed the public hearing and directed staff to bring the vacation for action at a future meeting when the final plat is ready.
Because council took no formal action on the vacation itself, no vote was recorded on the easement vacation at the Aug. 28 meeting.
