Council approves agreement with library foundation to build outdoor learning center

The Beatrice City Council voted 8-0 to approve a resolution authorizing an agreement with the Beatrice Public Library Foundation Inc. to create an outdoor learning center on city-owned property at the Beatrice Public Library.
Under the agreement, the foundation will hire contractors, pay for construction, and complete the work in phases; when each phase is finished the city will accept and own the improvements and be responsible for maintenance. A city staff member told the council the foundation may sell or place small naming elements such as benches or plaques but "the overall naming rights of the entire complex remain with the city."

City staff described three phases: (1) concrete work for a patio and sidewalk areas, (2) landscaping immediately adjacent to the building and (3) landscaping along the highway to provide a visual barrier. Staff said the foundation already has a preferred contractor, Sticks and Stones, which previously installed a water fountain in Chautauqua Park. The staff member said the foundation and the city had similar design renderings from JEO and that the foundation worked with JEO's interns on initial designs.
Council members asked how contractor selection and long-term maintenance would be handled. Staff said the foundation will manage contractor hiring and contracting; the city will still require permits and retain the right to require any project work to meet city standards before accepting the improvements. On funding for maintenance, staff said there is no perpetual-care fund provided by the foundation: once the city accepts the completed work, it becomes the city's responsibility. "With any other project, I always tell people that we'll maintain our standards," staff said.
The council praised the foundation for advancing the project. The resolution is numbered 7610 in the council packet.
Ending: Staff said the foundation hopes to begin initial construction this fall and that the foundation—s three-phase plan would return to the council as needed for oversight and final acceptance of each phase.
