Planning commission denies Solara Woods water-and-sewer exception after residents and staff raise safety, infrastructure concerns

The James City County Planning Commission on Sept. 3 denied the Solara Woods water-and-sewer subdivision exception request, a developer bid to avoid extending public water and sewer to a portion of property that lies inside the county's Primary Service Area (PSA).

The Development Review Committee (DRC) had recommended denial and county staff urged caution, citing potential impacts to neighbors and long-term enforcement burdens if in-home fire-sprinkler systems and private wells were substituted for public utilities. The planning commission's clerk announced the motion carried; the roll call was read into the record and the clerk stated, "Motion carries 4 to 2."

Why this matters: The applicant proposed a 38-lot subdivision served by individual wells and septic systems outside the PSA while extending a public road through a smaller parcel inside the PSA. County code interprets a new or extended road in the PSA as triggering public utility connection requirements for the portion in the PSA. Commissioners and the DRC said allowing a waiver could undercut the county's growth-management approach to protect rural lands and risk long-term public costs if private systems fail.
