Council approves noise permit for Talent Artisans and Growers evening market; two councilors recuse

The Talent City Council approved a noise permit on May 21 for the Talent Artisans and Growers Friday evening market, scheduled May 23, June 27, July 25 and Aug. 22, after two councilors recused themselves from consideration because of ties to the applicant.
Councilor Penomares moved to pull the item from consent so it could be considered separately; Councilor Cohen then moved to approve the permit for the four dates listed. Councilor Byers announced a recusal: “I will be recusing myself on the noise permit ... because I currently have a contract with the Talent Business Alliance.” Councilor Perry Miller also recused herself, saying she is “a paid employee of the Talent Business Alliance.” Assistant city staff cited Oregon law during the discussion; City Attorney referenced ORS 244.120 on conflicts of interest and the so‑called rule of necessity when a city lacks the minimum number of eligible councilors to act.
With the recusals noted, the remaining councilors voted in favor of the permit in a roll call and the motion carried. Council members agreed the permit application will be included in the meeting minutes because the application had not been in the packet.
Councilors discussed procedure: whether the permit needed to be on consent or pulled for discussion; councilors who were not recused participated in deliberation and the recorded vote. The council also directed staff to include the application materials with the meeting record for transparency.
