The Zoning Board of Appeals approved a 2-foot side-yard variance and granted permission to rebuild a garage at the original footprint after a vehicle collision damaged the structure; the rebuild meets nonconforming-structure standards in the code.
The Lorraine Zoning Board of Appeals approved Sept. 3 a request to rebuild a damaged garage at 1413 South Lipview Boulevard that is legal nonconforming under current setback standards. Vanco Construction representative David Bannes told the board the garage was struck by a vehicle and must be removed and rebuilt; the planned rebuild would replace the structure on its original foundation and footprint.
Planning staff reviewed the application under Section 1153.04 governing nonconforming buildings and structures and confirmed the submission met the listed requirements, including replacement on the original foundation and the six-month filing requirement. Staff said the proposed rebuild would remain in its existing location, which is a legal nonconforming placement owing to earlier standards.
Neighbor Frank Perhota, who lives south of the property at 678 Allison Avenue, asked whether the garage would move 8 feet to the south and was told the plan presented to the board follows the original footprint; any subsequent changes would require a new review. "I just wanted to make sure I'm all for this," Perhota said, adding he sees the damaged garage daily.
A motion to approve the rebuild as presented was made and supported; the board voted in favor and the motion carried. Staff and the applicant noted that any future alterations beyond the approved footprints would require returning to the board for review.
What happens next: Applicant may proceed to obtain building permits consistent with the approved rebuild plans; any proposed future modifications that change foundation or footprint will require additional review.
