The Village of Homer Glen voted to approve an intergovernmental agreement with Homer Township Road District to reimburse resurfacing costs for the segments of Bruce Road and 160 Seventh Street inside village limits, then subsequently voted to reconsider that approval and amend the IGA to make it subject to the village attorney's review.
Trustee Lepore described the measure as “getting money back” from a road construction project and supported the agreement. The board initially approved the IGA by roll call.
During a later motion to reconsider, the village attorney asked that the IGA be reviewed because the draft included a clause requiring the village to “indemnify and defend” the township road district. The attorney said he wanted an opportunity to negotiate a more neutral indemnity provision with the road district’s counsel rather than accept a one-sided obligation. The board voted to reconsider the approval and then approved an amendment making final approval subject to the village attorney's review.
Next steps: village legal staff will review the IGA language with township counsel and return a revised agreement for final execution when both sides reach mutually acceptable terms.
