Summary
The Zoning Commission voted 5–0 to convene an executive session on Sept. 11, 2025 at 3:15 p.m. to receive legal advice and deliberate on contested cases, and accepted a late favorable submission from the District Homeland Security and Emergency Management Agency into the record.
Chairman Anthony Hood moved and the commission voted 5–0 to hold a closed (executive) session on Thursday, Sept. 11, 2025 at 3:15 p.m. to receive legal advice from counsel and to deliberate but not vote on listed contested cases. The motion cited authority in the D.C. Official Code for closed‑session legal advice and deliberation. Commissioners Hood, Imamura, Miller, Wright and Stidham voted in favor by roll call. During preliminary matters at the Sept. 8 hearing, staff advised the commission that the applicant had filed two motions to accept late filings (a revised transportation review and a revised roof plan). The commission granted waivers to accept those late materials into the record by consensus during the hearing. Office of Zoning staff also reported receiving, shortly before the hearing ended, a late, favorable submission from the D.C. Homeland Security and Emergency Management Agency (HSEMA) that commented on floodplain coordination and recommended continued project coordination with agencies on floodplain and stormwater management. The commission accepted that late submission into the record and asked the applicant to coordinate with HSEMA and other agencies during permitting. The commission closed the public hearing on Case No. 25‑07 after inviting the applicant to file a proposed summary order and to add requested supplemental materials. Office of Zoning staff requested the summary order within two weeks so it could proceed to processing.
