Commission approves removal of split tree at 413 Center Street; commissioner recuses

The Historic District Commission approved removal of a significant tree at 413 Center Street on Aug. 25 after staff review found the tree was split in a storm and posed a risk to life or property.

Tara, planning staff, said the application included photos showing the tree had split and caused damage to a neighbor’s pool fence, roof, bushes and an electrical panel. Staff noted there was no letter from a landscape firm, but the photographic evidence showed damage and a potential immediate risk. Staff recommended approval with conditions that a canopy replacement tree from the recommended species list be planted outside the right of way and that the stump be removed or ground to surrounding surface level.

Commissioner Jason Covington disclosed he owns the lot and recused himself from the deliberation and vote. Covington told the commission he had purchased the lot to build a house, described the tree as hollow and said, "I'd like to go ahead and remove that." He left the dais for the vote.

Jenny Davis moved to approve planning staff recommendations; the motion was seconded and passed unanimously among the remaining commissioners. The removal was approved with conditions requiring a replacement canopy tree and stump grinding or removal.

The commission's role was limited to review under the Old Conway Design Overlay District tree preservation standards; the action permits the tree removal with specified replacement and stump treatment.
