Commission approves preliminary plat for Oak Grove PUD with conditions; private drive ownership unresolved

The Conway Planning Commission recommended approval of the Oak Grove planned unit development preliminary plat Tuesday, a 6.52‑acre, 19‑lot subdivision that was approved as a PUD in 2021 and modified in May to allow up to 42 dwelling units.
Planning staff said Oak Grove is zoned PUD for one‑ and two‑family dwellings and aligns with the Oak Street Ahead corridor plan for medium‑density infill. "It is zoned PUD to allow, 1 and 2 family dwellings up to 42 dwelling units," staff said. The plan area was described as a private drive that becomes Museum Drive and will be privately maintained by a property owners association.
Staff reported 11 proposed conditions and some technical corrections are required before final plat. A significant outstanding issue is ownership and improvement of an existing access drive that appears as a 20‑foot access easement on adjacent plats. "We are currently working with the property owners because...the right of way there does encroach a little bit onto that existing access drive," Lauren, a planning staff member, said. Staff said deed searches dating to the 1980s show past dedications, but current ownership must be confirmed; if the lot owners own the easement, the POA will improve it, otherwise staff will negotiate improvements with the easement owner.
An ABG Group representative (Bobby, representing ABG Group, office at 1021 Front Street) told commissioners the easement exists and that the property owners are weighing whether to gate the private drive. "So, they'll have access, but whether or not they have a gate...they may end up not even putting a gate up there," the representative said.
Commissioners voted to approve the preliminary plat with the corrections and conditions listed in the staff packet. The motion passed on a voice vote; commissioners responding "Aye." The approval was for the preliminary plat recommendation—final engineering and ownership clarifications remain before final platting.
Discussion vs. decision: staff presented the PUD, commissioners asked questions about the private drive and easement ownership, the applicant offered clarifications, and the commission approved the preliminary plat subject to conditions. The commission did not finalize ownership of the access easement at the hearing.
The planning commission's recommendations are forwarded to City Council; staff said items from the agenda may be considered by City Council as early as Aug. 26.
