Council amends zoning to comply with Missouri law, allows no-impact home-based businesses and permits farm stands by right

The council approved Ordinance 25-09-02 on Sept. 2 to amend the zoning code in response to Missouri statutory changes affecting home-based businesses. City Planner Joshua Garrett told the council the 2022 state law creates two categories: "no-impact" home-based businesses, which the statute allows cities to permit by right if they meet specified criteria, and other home-based businesses, which may be subject to local regulation. The updated city text permits no-impact home-based businesses by right and requires other home-based businesses to seek special-use permits that the council would approve or deny.
Garrett also said the ordinance separately authorizes farm stands by right as an accessory use in designated residential zoning districts, provided they meet the ordinance's requirements. He explained that legally operating home-based businesses that exist today would be grandfathered and the change is generally less restrictive than the prior code, which had a prescriptive list of permitted home occupations.
The Planning and Zoning Commission considered the amendment on Aug. 25 and unanimously recommended approval; the council adopted the ordinance on a unanimous roll-call vote. The change affects how staff and neighbors review and notice new home-based operations going forward.
