Mayor Rockingham’s public statement that North Chicago would not support Immigration and Customs Enforcement (ICE) operations using city police or jails without a signed judicial warrant prompted a council discussion on whether to adopt a formal legislative declaration designating the city a sanctuary.
Alderman January and others said they had not been informed in advance of the mayor’s statement and asked that the mayor include aldermen when the administration issues statements that could affect residents. January asked whether the council could adopt a legislative resolution to back the mayor’s directive. Council members expressed support for the substance of the mayor’s approach but sought a formal process so aldermen could respond consistently to constituent questions.
The city attorney explained that the mayor’s letter reflected practices consistent with the Illinois Trust Act and described legal limits on local cooperation with federal immigration detainers: local law enforcement should comply with warrants signed by a judge but is not required to hold individuals at the federal government’s request without judicial authorization. The attorney warned that adopting a formal “sanctuary city” label could invite heightened federal attention and potential legal challenges; by contrast, a legislative resolution aligning police practices with the Illinois Trust Act would provide a municipal policy basis for the mayor’s directive.
Council members asked the administration to circulate copies of the mayor’s statement to aldermen and to consider drafting a legislative action if the council wished to codify the policy. At least two aldermen said they personally supported the mayor’s approach to following the Illinois Trust Act but asked for inclusion in communications so they could answer resident inquiries. The mayor agreed to notify aldermen in the future about similar statements.
