Montgomery holds required public hearing on proposed vacation of Elliot Avenue right-of-way

The Village of Montgomery opened and closed a public hearing Tuesday on a proposal to vacate a segment of Elliot Avenue to allow the adjacent Wayside Cross / Saint Olaf development to incorporate the land into its site plan.
At the hearing Sonia, a village staff member, told the board the public hearing is required by state statute before the village can vacate any street right-of-way and convey it to adjacent property owners. She said the hearing was published and that no action would be taken at this meeting; any vacation ordinance would return for a later vote if the associated project proceeds.
President Brawley opened the hearing and asked for public comment; hearing none, he closed the public hearing. Sonia confirmed that the village will not vacate the right-of-way unless and until the related development project comes forward for approval.
Because no public comments were offered and no ordinance was before the board tonight, the village took no formal action and made no commitment to the vacation. Any ordinance to vacate Elliot Avenue would be considered alongside the project approvals at a future meeting.
The public hearing fulfilled the statutory requirement but did not change the status of the right-of-way; staff said the matter will return if and when the developer’s project and related approvals are submitted.
