Tyson warned that if the county vacated the right‑of‑way all the way to Cottingham Street, an adjacent homeowner on the southwest corner might have a potential claim for damages tied to access; claimants have one year from an order to bring damages claims in that scenario.
Tyson recommended stopping at visible stones that mark a boundary to avoid exposing the county to a potential claim. He said the statutory procedure requires publication of a description of the portion to be vacated, mailing notice to adjacent landowners and later entering a resolution vacating the land after the publication period. Tyson said he would work with DJ (county attorney) to draft the legal description and the notice and return to the board for approval of the published notice before any resolution.
The board made and approved a motion giving Tyson authority to work with the county attorney on the legal description and notice. The motion passed by voice vote.
