The Galena Zoning Board of Appeals opened a public hearing and then voted on a finding of fact to recommend rezoning parcel 22-101-353-00812 from heavy industrial to medium-density residential to allow construction of a two-car accessory garage. The application was presented by Scott Branson (transcript also shows an alternative spelling: Scott Glanson), who said he and his wife bought the property about four years ago and only later realized one of the lots carried a heavy industrial zoning designation.
During public hearing, Branson said the two lots were purchased together and that the vacant lot zoned heavy industrial was intended to be used for a garage: “we've bought that house about 4 years ago.” A nearby neighbor, Rick Barriser, spoke in support, noting he lives about 50 feet away and reported no parking or guest issues related to Branson’s B&B operations.
Board members reviewed rezoning criteria, discussing whether the original zoning designation was an error at adoption, compatibility with the surrounding area, conformance with the comprehensive plan, availability of public facilities and a community need. A board member described the rezoning as “one of the biggest no-brainers in the history of zoning,” and another noted the local topography and historical lot ties to nearby industrial uses and the railroad.
A motion to forward a positive finding of fact on calendar number 25A-04 passed on roll-call vote. The transcript shows the board concluded the rezoning request met the criteria and approved the finding of fact.
