At a joint hearing, Teton County planning staff and the applicant presented an amended preliminary plat that would subdivide Lot 7 in the Either Acres subdivision into two parcels of just over one acre each. Staff told the commission the site is generally consistent with surrounding one‑acre lots in the subdivision, has individual septic and well feasibility, and does not contain natural resource overlays or floodplain restrictions that would bar development.
Planning staff’s primary technical comment concerned an access-and-utility easement shown on the plat extending to the northern property line. Staff asked the applicant to clarify that the easement is intended for utilities and not for stub vehicular access to the neighboring parcel. Staff recommended approval with conditions: submission of drafted deeds for the new parcels and a revised easement note clarifying utility-only access.
Applicant representative Nick Mestry said the plat conforms to the neighborhood pattern and that individual wells and septic systems are proposed; he noted the subdivision’s community well has no available capacity and the HOA confirmed there is no additional water to serve new lots. No public commenters appeared at the hearing, and commissioners concluded the subdivision preliminary‑plat criteria in Title 9-3-2(c)(8) were satisfied.
A motion recommending approval of the amended preliminary plat was made and seconded; a roll call recorded “Aye” votes from Commissioners Glover, Kohut, Mosley, Kirkpatrick and Barker. The commission’s recommendation will be forwarded to the Board of County Commissioners for preliminary and final-plat hearings, with staff conditions to be addressed in the next submittal.
The conditions included filing draft deeds and clarifying the access and utility easement language on the plat; any required public works or EIPH approvals will be checked prior to BOCC preliminary review.
