Committee approves vacation of historic Snowberry right-of-way to clear title

The Land Use Planning Committee voted to send favorably to the full council a petition to vacate an historic right-of-way alignment of Snowberry Road that, according to title research, traverses private land but does not provide practical access.
Sean Klein of the Area Planning Commission explained that an 1860s-era dedication (located in county commission records) described Snowberry following a different alignment; a modern survey found the original dedicated right-of-way cuts across a parcel that is farmed and provides no contemporary access. APC staff recommended the county vacate the unused historic strip to clear title.
Brandon Dickinson, representing the property owners, told the committee the ALTA survey revealed the discrepancy and the vacation would remove a cloud from title, allowing the property transaction to proceed. Dickinson said the issue likely went unnoticed because the acreage has been used as farmland for decades and title searches had not previously required clarification.
The committee voted to send Bill 32-25 to the full council with a favorable recommendation.
