Stormwater board approves $5,500 amendment to Kleinpeter contract for Brookside Park work

The Lawrence City Stormwater Advisory Board on April 28 approved an amendment to a consulting contract with Kleinpeter Consulting Group LLC that raises the total from $53,000 to $58,500 to cover work tied to Brookside Park stormwater improvements.
Board President Brad Klopfenstein opened the item as new business and invited questions from staff and board members. Chris Wilborn, Department of Public Works, described the original agreement and the reason for the requested increase. “The City of Lawrence entered into an agreement on March 17, 2023, with Kleinpeter Consulting Group LLC to work on stormwater improvement projects,” Wilborn said. “We anticipate that there will be a net change of about $5,500 from the original $53,000 for a total of $58,500.”
Wilborn told the board the proposed increase grew out of construction delays and extra milling tonnage during work at Brookside Park. He said the amendment reflects costs incurred while preparing contract modification letters, grant-management communications and related processing steps. The additional time and changes to the scope were documented on November 30, 2024; January 31, 2025; and April 30, 2025, Wilborn said, and an April 15 submission sought an extension that would run until August pending grant-manager notification.
A board member asked whether the city could back-charge the contractor responsible for the delays; Wilborn replied that the fees in the amendment do not address cost recovery and that the Department of Public Works, together with the city legal department, would pursue any recoupment under a separate process. Wilborn also told the board that Kleinpeter had been “very flexible and accommodating” and that the city foresees a continuing relationship.
Rob moved the motion to accept the amendment and Tracy seconded. The board voted in favor; the motion passed.
The amendment does not include a contract number in the board record and no additional funding source was identified during the discussion. Wilborn said the change represents a $5,500 increase and that questions about contractor accountability will be handled separately by DPW and the city attorney. The board did not request further changes to the amendment before voting.
The board moved on to the next agenda item.
