Committee votes to repeal overlapping noise section and rely on detailed nuisance noise code

City Attorney Jenna Throw told the Health and Public Safety Committee that Bill 27‑25 would repeal section 13‑81 of the municipal code because section 13‑57 already contains detailed and enforceable nuisance noise provisions, including technical decibel standards and other criteria.

“Section 13‑81 was essentially less detailed,” Throw said. “It was our recommendation to focus on enforcing 13‑57, which covers basically the same topic.” Kylie Connell of the legal team confirmed code enforcement and police typically respond to noise complaints; officers investigate and may issue a noise ticket when evidence supports a violation.

There were no public speakers. A motion to send Bill 27‑25 to the Committee of the Whole with a favorable recommendation passed on a roll call (five ayes). Staff said the repeal is intended to reduce confusion that could arise from two overlapping sections and does not remove the city’s authority to address nuisance noise: enforcement will continue under the more detailed section 13‑57.
