Council adopts updated floodplain regulations to maintain NFIP participation

The Common Council voted unanimously to adopt Bill 23-25, which revises Chapter 6, Article 9 of the South Bend Municipal Code to update local floodplain regulations and preserve eligibility for the National Flood Insurance Program.
City Attorney Jenna Throw told the council the ordinance language “comes straight from a model ordinance that was provided to us by the Indiana DNR” and that the DNR reviewed the draft before it was filed with the council. Randy James, building commissioner, said the updates are required by FEMA and the Indiana Department of Natural Resources for continued participation in the NFIP and noted the city already has about $18 million in covered properties in South Bend.
Council discussion confirmed the ordinance had undergone multiple submissions to the DNR before acceptance; staff said once adopted locally the ordinance will be forwarded to DNR and FEMA for final administrative approval. The bill passed on third reading by roll call, nine ayes.
