Commissioners and staff discussed zoning, setbacks and permitting; Ben (staff) cited the front-yard requirement for the current "variety business" zoning category, saying a front yard of not less than 25 feet is required unless a variance is obtained.
Staff said contingencies in the sale agreement will include the buyer's ability to obtain necessary building permits, verification of zoning and utilities, and confirmation that seller‑side taxes (if any) are resolved. Commissioners encouraged the applicant to consult planning and building officials before proceeding and noted the commission owns other parcels that could be an alternative if this lot's dimensions or zoning present barriers.
The commission approved the sale by roll call. Staff will provide the applicant with a draft agreement to review and reminded the applicant that permits, variances or utility verifications are separate processes the purchaser must complete before construction.
