MUNCIE — The Muncie Board of Public Works and Safety on April 30 approved a memorandum of understanding with Hickory and Elm LLC that grants the city a perpetual right-of-way easement for six feet of property at 655 North Elm Street to support a road-widening project.
The agreement, presented by Adam Leach, an engineer representing Hickory and Elm LLC, includes a perpetual grant of right-of-way and provides that the city will remove a dilapidated structure on the property. Leach said, “we need 6 feet of 655 North Elm Street,” and that, in return for the easement, the owner will receive demolition of the structure at no additional payment.
The memorandum and the attached perpetual easement were taken together in the motion the board approved by voice vote. The board president called for the vote and members signified approval; the minutes record the motion carried.
City controller Craig Wright had earlier presented the weekly register of claims and noted a larger EMS claim with Stryker for cardiac monitors, but the easement request drew the main exchange specific to property and construction logistics. Board members asked procedural questions and confirmed the owner-signed copy of the agreement was available to staff for execution.
The MOU will allow the city to proceed with the planned road work on North Elm that requires the additional right-of-way; the board did not specify a demolition schedule or project timeline during the meeting.
