The Evansville common council on April 28 adopted Ordinance R2025-06 (amended) to rezone property commonly known as 1031 Mount Auburn Road from an M-2 industrial zone to M-1, permitting a multi-tenant commercial use including professional offices.
Cassie Virgin of the Area Plan Commission summarized APC Docket REZ‑2025‑009 and noted the site’s history: permitted in 1990 as a health-club building, later hosting an x‑ray imaging business and a martial arts school. The APC recommended approval (8–1 recommendation recorded as eight affirmative votes in the APC report) on the condition the applicant file a use‑development commitment (UDC) to prohibit higher‑intensity disfavored uses abutting residential property.
Roger Lehman, representing the applicant R. Lehman & Son Consulting on behalf of Shellback Realty LLC, confirmed the request is effectively a down‑zoning from M-2 to M-1 to legalize existing multi‑tenant office and similar uses. The applicant later worked with the Mount Auburn Neighborhood Association to produce a list of prohibited uses and filed an amended petition on April 14 including the UDC.
The council recorded a voice vote to accept the amendment and then a roll call on adoption; the final roll call recorded nine ayes, and the ordinance was declared adopted.
