Commissioners approve Eagles Landing Estates subdivision in Precinct 3 under Texas Local Government Code

The Newton County Commissioners Court approved the plat and plan for Eagles Landing Estates subdivision in Precinct 3 under Chapter 232 of the Texas Local Government Code.

County staff presented the subdivision and said all elements reviewed so far comply with county subdivision guidelines. The court heard from a representative of the landowner (Tom and Karen Bennett) and from staff that County Road access extends to the property and that the plat proposes a cul-de-sac; the court was told there will be no county-maintained roads within the subdivision and that road maintenance will be the responsibility of landowners.

Staff also presented a letter from the Sabine River Authority (SRA) and noted that on-site sewage facility (OSSF) planning materials and soil testing were reviewed and determined by the Texas Commission on Environmental Quality (TCEQ) guidance to meet minimum requirements for on-site sewage systems. Staff said each lot will require individual on-site sewer and water (wells) and that utility easements will be required to keep separation between wells and septic systems.

The county attorney reviewed the plat paperwork and subdivision requirements with the judge and said she had reviewed the materials but was not offering a technical sign-off on septic or water suitability (noting that such on-site system assessments are not her technical specialty). The court accepted staff assurances, noted testing and SRA clearance, and approved the order to accept the Eagles Landing Estates plat.

A motion to approve the subdivision plan was made and seconded; the court voted in favor of the plan.
