The House Committee on Human Services and Homelessness voted to pass SB1312 SD1 with technical amendments on March 11, 2025. The measure clarifies that repayment of a loan cannot be used to create a statutory loophole in prosecutions for profits from prostitution.
William Bento of the Office of the Public Defender said the Ibarra prosecution highlighted an ambiguity in current law that produced what he described as an “absurd result” when a loan between acquaintances was repaid using proceeds from prostitution. Bento suggested the Legislature consider narrowly targeted language to avoid prosecuting ordinary loans that later happen to be repaid with unlawful proceeds.
Daniel Hugo of the Honolulu Prosecutor’s Office opposed adding language Bento proposed, saying it could introduce multiple states of mind and confuse prosecutions. He referred to a dissent in the Ibarra opinion and said the bill was intended to close a loophole that would otherwise allow debt‑based arrangements to be used to hide criminal activity. The Deputy Attorney General, Trisha Nakamatsu, testified in strong support, saying the bill “closes the loophole” that can arise when indebtedness is used to disguise an agreement to repay via prostitution.
A community Zoom testifier also spoke in support and urged robust enforcement of laws targeting organized exploitation and trafficking.
The committee adopted the chair’s recommendation to pass SB1312 SD1 with technical edits.
