During public comment at the Jan. 28 Marine Resources Commission meeting, the commission approved two license‑related requests.
First, the commission granted Mary Brittenhouse Rowe permission to transfer her late husband’s oyster user fee to a local buyer; the commission authorized staff to process the transfer with shellfish program staff.
Second, Thomas Carlson Jr. asked the commission to reinstate his oyster license after several years without purchasing the user fee. VMRC records showed the last purchase in 2020 and a prior enforcement record (a 2019 guilty finding for harvesting in a closed area followed by a three‑year probation/revocation period). Commissioners reviewed the license history and prior enforcement, and some raised concerns about the length of non‑purchase gaps and prior violations.
Associate Member Headley moved to reinstate Carlson’s oyster license on the condition that he pay back user fees for the years he missed (2021–2025 inclusive). The motion, seconded by Associate Member Branson, passed 7–1 with Associate Member Hand voting no. Staff noted that paying back prior years can make a license transferable under existing regulations; commissioners discussed whether the commission or SMAC should consider broader regulatory changes about license transfers and long gaps in renewal.
Staff directed license‑program staff to process the authorized transfer for Ms. Rowe with the shellfish office and to accept Carlson’s payment and reinstate the license once fees were paid and any administrative conditions were met.
