The Kaneland CUSD 302 Board of Education voted 6–0 on May 12 to authorize the superintendent, in consultation with the board president, to file a lawsuit challenging the Village of Sugar Grove’s redevelopment area designation, the associated project area and the village’s tax‑increment financing (TIF) approval and related actions.
Superintendent Dr. Brian Rolling introduced the item and said district counsel had been present in recent discussions with the new Sugar Grove village leadership. Mr. Gordon (speaking for the district) said the district and village recently met with the new village president and village attorney; the meeting was confidential but constructive and represented an early step toward a non‑litigation resolution. Gordon told the board his firm recommended the authorization so the district could file promptly, if needed, without waiting for a next board meeting during the summer.
The board motion authorized the filing of suit at the superintendent’s direction in consultation with the board president; the motion passed on a 6–0 roll call. Board members emphasized they expected regular updates and agreed the superintendent and counsel should notify board members about significant steps; participants stressed the district must avoid prohibited quorum discussions when communicating with individual board members outside a public meeting.
Administrators said the authorization is intended to preserve the district’s ability to act if discussions with Sugar Grove do not produce an acceptable resolution; it also allows a window for negotiation with the new village leadership before pursuing litigation.
