Committee passes amendments to HB1378 to restructure State Foundation funding and establish performing arts special fund

On Feb. 12 the House Committee on Culture, Arts & International Affairs moved to pass HB1378 with amendments that change how the State Foundation on Culture and the Arts is funded and governed in certain respects.
The chair noted that, based on the Attorney General’s testimony, the committee will delete Section 5 (page 5 line 15 through page 7 line 4) and establish a performing arts special fund in the state treasury. Revenue sources listed for the special fund in the amended language include legislative appropriations, revenues and charges collected by the foundation, surcharges, grants, gifts and interest earned on deposited monies.
The amended special fund is designated for coordination, planning, promotion, marketing and execution of performing arts events; the committee also added a statutory definition for performing arts and set granting standards. Appropriation language in the original draft was left blank and the proposed sum will be reported in the committee report; the bill was assigned a defective date placeholder of 07/01/3000 in committee amendments.
Committee members recorded no objections to the amendment package and adopted the recommendation to pass HB1378 with amendments. The committee did not specify an implementing department in the hearing record, and the report will reflect the deleted section and the revised special fund language for statutory drafting.
