The Senate Committee on Commerce, Science, and Transportation on the morning of the markup voted to favorably report Ariel Roth’s nomination to be assistant secretary of commerce for communications and information at the Department of Commerce.
Chairman Ted Cruz, presiding over the committee, introduced Roth and described her qualifications, saying, "Ariel is an exceptional candidate for this position," and noting her experience as the committee’s policy director for telecommunications and prior staff roles at the FCC and in Congress. Cruz also recounted a personal detail—that Roth gave birth to a baby girl at 12:10 a.m. on the day of the committee vote—and urged a bipartisan vote in committee.
Why it matters: NTIA oversees federal communications policy and administers major broadband grant programs. Ranking Member Maria Cantwell said she could not support Roth’s nomination because she did not hear an explicit commitment that Roth would preserve and honor the administration of the BEAD (Broadband Equity, Access, and Deployment) program and other federal broadband investments already approved by Congress. Cantwell said the committee needs NTIA nominees to commit to an "evidence-based" approach to spectrum policy and to safeguard the federal grant programs Congress has enacted.
Committee action and vote: Senator Roger Wicker moved that PN2225, the nomination of Ariel Roth, be favorably reported. The motion was seconded and a roll call was held. The committee recorded 15 yes votes and 13 no votes; the chairman announced, "The motion is agreed to, and the nomination is ordered to be favorably reported." The committee clerk conducted the roll call prior to the announcement.
What supporters said: Cruz and other supporters emphasized Roth’s telecom policy experience and her familiarity with spectrum and broadband issues. Wicker—who moved the nomination—commended Roth’s work and urged committee support.
What opponents said: Cantwell raised two central concerns during the markup: (1) commitment to honoring BEAD allocations to states, tribes and territories (she cited $42,000,000,000 lawfully allocated under the BEAD program) and (2) whether Roth would await or act on evidence from ongoing interagency studies before reallocating spectrum that may affect national security and public-safety systems. Cantwell also raised potential conflicts of interest related to private-sector actors and urged fuller answers for the record.
Next steps: With the committee’s favorable report, Roth’s nomination is placed on the Senate’s executive calendar for consideration by the full Senate. Any recorded votes in the full Senate will appear in the Senate’s official record.
Provenance: The committee announced it would "consider the nomination of Ariel Roth" at the start of the markup; the committee later concluded the motion was agreed to and ordered the nomination favorably reported (transcript excerpts cited below).
