Legislature passes revision to child-care neglect code section after committee perfection and floor votes

On May 5 the Jackson County Legislature passed ordinance 5981, repealing subsection 5,560.3 of the Jackson County Code (1984) and enacting a new subsection addressing recklessly failing to care for or control a child.
The ordinance came from the Justice and Law Enforcement Committee, which recommended perfection. The clerk recorded the perfection vote as seven yes, one no and one abstention. On final passage the clerk recorded the roll call as six yes, two no and one abstention. Legislator Sean E. Smith cast a recorded no vote on both perfection and final adoption; Legislator Manny Abarca recorded an abstention on the perfection vote. The ordinance therefore passed by a recorded roll-call majority.
Committee and floor remarks noted the committee recommended perfection before final adoption. The legislative record does not show additional substantive amendments on the floor beyond perfection and adoption votes recorded by the clerk.
The ordinance replaces the county code subsection listed above; the clerk’s roll calls indicate a recorded split among members on final passage but the ordinance was adopted.
