Legislature debates planning commission appointments as three land-use ordinances are perfected

Marshall said applicants face financial burdens because they have already paid for construction and planning while awaiting county action.
Legislator Sean E. Smith said the planning commission had only three members with current, non-expired appointments and argued that allowing recommendations from a commission with a majority of expired terms erodes the legislature’s authority to review appointments. He described not reappointing members after term expiration as “a usurpation of our legislative authority.”
Caleb Clifford of the county executive’s office responded that the planning commission is currently constituted and has a quorum, but he said he would check whether particular members wished full-term appointments. Clifford also noted that some individuals are serving holdover terms because they are unwilling to commit to a full multi-year term.
Legislator Manuel Barca and others asked whether the executive branch could reappoint members to fill vacancies so the commission would have more current members. Clerk and chair directions clarified that perfection of the ordinances could proceed and that the question of reappointments would be taken up as unfinished business.
On the floor the legislature moved to perfect ordinance 5974; the clerk called the roll and recorded nine yes votes for perfection. The body likewise perfected ordinances 5976 and 5977; each perfection recorded nine yes votes. Legislator Smith said he would prefer to delay adoption until the county executive’s office committed to reappointing additional planning commission members by the end of the month, but the chair said the body could perfect now and adopt later.
