Springdale Town Council on March 12 approved a four-month extension to the building-permit deadline in a 1995 mutual release and settlement agreement with Kent and Robin Palmer to allow time for the town and the applicants to complete review of construction drawings and issue a permit.
Town staff member Tom Dancy told the council the Palmers completed design development review with the planning commission and submitted construction drawings but delays in the town’s review — described as a lengthy punch list from the town engineer and building inspector — prevented issuance of a permit by the March 1 deadline. Dancy and staff requested a three- to six-month extension and proposed a June 1 date; the council adopted four months from the March 12 meeting date.
The council framed the extension as a permissive, time-limited accommodation while keeping pressure on the applicants to finish outstanding items. Council members questioned whether three months would be sufficient and discussed a longer six-month interval; members settled on four months so staff and applicant would have additional breathing room without removing accountability. Dancy said the remaining work is the applicant’s response to the engineer’s punch list and a re-review by the town’s engineer.
Motion language recorded at the meeting directed approval of the extension to the building-permit deadline established in the amendment to the 1995 mutual release and settlement agreement between the town of Springdale and Kent and Robin Palmer, effective four months from March 12, 2025, and authorized the mayor to sign the amendment. The council vote was recorded as: Jack Burns, aye; Randy Eton, aye; Barbara Bruno, aye; Pat Campbell, aye; Kyla Topol, aye.
The project that prompted the extension involves roughly 14 acres behind Fatale Gallery and adjacent parcels, and council members said they want the future redevelopment — described during the meeting as restaurant and retail uses — to move forward given potential benefits to that portion of town.
The council did not set additional conditions beyond the extension. Staff said if the applicant does not complete the resubmittal and permit issuance within the four-month window, the item will return to the council for further action.
The council’s action preserves the existing settlement agreement while exempting the specified portion of property for an additional four months to permit building-permit processing to finish.
