Johnson. Rodney Phillips made the motion to grant the extension and Alicia Kingsbury seconded it; the motion passed by voice vote.
Applicant representative Jeff Green told the board he had obtained state approvals needed for the building permit phase and that foundation and building plans were complete. Green said the outstanding step was the town engineer's final review. “We're at the town engineer review,” Green said, adding he had funds available to pay for that review and an engineer now on board to finish the work.
Nearby residents and abutters raised concerns about current excavation activity. Philip Brown and Lloyd McCarthy (residents on Staniels/Samuels Road) told the board they were worried about truck traffic on narrow local roads, and that a portion of the site appeared to be dewatered “because they're so low,” potentially within four feet of the seasonal water table. A board member noted that excavation can proceed under incidental work rules only after an intent‑to‑excavate filing is made; Green said he would ensure the town received the required intent filing.
The board discussed imposing a condition that if work is not completed within the 90 days, the applicant must resubmit as a new application; members observed the conditional approval language could expire if improvements are not constructed within the timeframe. The motion approved the 90‑day extension; the board recorded no further conditions in the motion.
