The City of Poughkeepsie Common Council voted on May 6 to remove a restrictive covenant adopted in 1995 for property now known as 271 Church Street (formerly 317 Church Street). Council discussion noted a potential purchaser and that Hudson River Housing had communicated about plans consistent with current zoning.
Councilman Chris Grant, whose ward includes the property, said he had discussed plans with Hudson River Housing and the potential buyer and supported removing the covenant so the parcel could be considered for housing. He told the council the prospective use would comply with zoning and did not seek major variances. Grant said, "I'll be in support of this resolution."
Vote and outcome: The roll call returned eight ayes and one abstention (Vice Chair Shook abstained due to a professional conflict noted earlier). The chair announced "8 ayes, 1 abstention" and the motion carried.
Why it matters: Council members said the city faces a housing shortage and that removing the covenant could allow additional housing opportunities on the site while remaining subject to the city's zoning process. The 1995 covenant had been intended to limit development on the parcel; removal opens the property to proposals that comply with current land-use rules.
Next steps: The property owner or potential purchaser will proceed with any development proposals through the city’s normal planning and zoning review processes. Council did not approve a specific project at the May 6 meeting; the action removed the covenant so future proposals are not constrained by the 1995 restriction.
Ending: Council members asked that any future project follow established zoning regulations and return for required approvals and, if needed, public hearings.
