Council approves ordinance correcting right-of-way name in Persimmon Grove subdivision

The Excelsior Springs City Council approved Ordinance 25-02-01 on Feb. 18, 2025, to vacate and correct the recorded description of a public right-of-way in the Persimmon Grove addition after a title company raised a discrepancy between the subdivision plat and current references.
Melinda Mahaffey, director of economic and community development, told the council that a title company reviewing the sale of property at 331 Persimmons identified language on the original 1920s plat that refers to the right-of-way as Rowell Avenue, while the city and residents generally refer to it as Persimmon Avenue. The ordinance corrects the legal description for title purposes; Mahaffey said the city will continue to refer to the street as Persimmon for everyday use.
Because this was an ordinance, council members took a first reading and then a second reading during the meeting. Council members moved to take Ordinance 25-02-01 to second reading and then voted to adopt it on second reading; the roll calls recorded “yes” votes from Councilman McGovern, Councilman Rennie, Councilman Saint John, Mayor Pro Tem Speer and Mayor Spahn.
The ordinance was enacted to align municipal records with the title company’s requested legal language; council did not attach additional conditions. The city clerk completed the recorded motions and roll-call votes.
