Council approves MPEDC employment agreement, articles amendment and a settlement following executive session
Summary
After executive session the council authorized a settlement in cause No. 43346, approved an employment agreement for the interim MPEDC executive director, and adopted an amendment to MPEDC articles to recognize holdover board status under Texas law.
Following executive session the Mount Pleasant City Council took several actions related to the Mount Pleasant Economic Development Corporation (MPEDC) and outstanding litigation. The council authorized the city attorneys to complete a settlement in cause No. 43346 (Lewis and Alma Lozano's appeal of a special commissioner's award), approved an employment agreement for the MPEDC interim executive director incorporating revisions discussed in executive session, and passed a resolution amending previously approved MPEDC articles of incorporation to add language permitting holdovers consistent with the Texas Constitution.
City attorney Lee Ream explained the articles amendment would clarify holdover provisions that apply while projects approved by council are being implemented; staff said the amended language would be signed by the EDC president and filed with the secretary of state. Council moved to authorize settlement of the Lozano appeal and to approve the interim executive director's employment agreement; both motions passed by voice vote.
Council also directed staff to file the amended MPEDC articles promptly and to proceed with implementation of the employment agreement as approved by the MPEDC board and revised by council action.
