Planning commission grants conditional use permit for home daycare at 1098 Third Street

The City of Eagle Pass Planning and Zoning Commission voted to grant a conditional use permit to Carlos and Yolanda Riojas to operate a home daycare at 1098 Third Street.
The permit, approved by the commission during its meeting in Council Chambers, allows the existing single-family dwelling to continue operating as a child daycare business under conditions recommended by city staff. The conditions include a maximum of 12 children, hours of operation limited to 7 a.m. to 6 p.m. Monday through Friday, a five-minute limit for parent drop-offs and pickups, one unlit sign attached to the building not to exceed 6 square feet, a prohibition on nonresident employees, and a nontransferable permit that requires renewal after one year.
City staff told the commission the parcel is in an R-3 duplex zoning district and that the daycare had been operating without the required conditional use permit; staff recommended the CUP to bring the operation into compliance with the City of Eagle Pass Code of Ordinances. Staff reported that notice letters and a legal notice were published, and that two written letters of support were received and none in opposition.
Carlos Riojas, who was in the audience, told the commission the daycare has been operating for decades: "25 years," he said when asked how long the business had been in operation, later specifying "November sixteenth of 1999."
The commission approved the permit by voice vote. The conditional use permit is nontransferable and will require renewal after one year.
The permit approval applies only to the use and conditions described; any future changes to the site, structure, number of children, staffing or signage would require further review and compliance with applicable city codes.
