The commission voted unanimously to recommend that the City Council grant a subdivision variance permitting the developer of Lot C, Block 4 of Rio Estates Subdivision Unit 3 to file a final replat directly without first obtaining preliminary replat approval as required by City of Eagle Pass ordinance section 23-36(a).
Staff described the parcel (approximately 2.7482 acres, 119,713 square feet) at 1761 Rio Drive as vacant and of sufficient size to meet or exceed R-1 (single-family dwelling) district standards. The developer, represented in the meeting by Mountain View Engineering and a representative identified as Mr. Canales, said the final plat application was under review and that sidewalks and other public improvements would be constructed as houses are built.
Commissioners asked staff whether conditions for plat approval had been met; staff said final technical reviews were still in progress but recommended the commission forward the variance to council. A commissioner noted typical concerns when lots are sold and services (water, sewer, electric) are not yet separately provided to each newly formed lot, and staff confirmed those service connections and sidewalk construction would occur at permit or final-plat stages.
The commission’s recommendation directs the request to city council for final action and enables the applicant to continue with final plat processing pending council approval and completion of required technical reviews.
