The Town of DeWitt Planning Board approved a site plan for Upstate Pathology Lab Ownership, LLC to construct a multi-level medical pathology facility on property with access from Fly Road, subject to multiple conditions including completion of the DEC wetland-delineation process and compliance with county and state drainage and access requirements.
Board materials read into the record describe the project as a three-story building with a footprint of about 38,000 square feet and a total of 108,928 square feet of floor area for medical pathology operations, parking, EV charging, utilities and stormwater mitigation. The planning board declared a negative SEQR determination and stated it would act as lead agency for the project’s environmental review.
The board’s approval incorporates several outside requirements: the applicant must coordinate stormwater and drainage plans with the New York State Department of Transportation and submit the stormwater pollution prevention plan and lighting plan for DOT review; the applicant must also coordinate sewer connection and stormwater details with the Onondaga County Department of Water and Environmental Protection. Any mitigation the state or county requires will be conditions of site-plan approval, the board said.
The board noted two area variances granted by the Zoning Board of Appeals on Jan. 21, 2025: an increase in reserved parking from 25% to 44% under Town code and a variance allowing a dumpster and truck-dock area in the front yard where the town code generally requires refuse areas be located to the side or rear. The Onondaga County Planning Board referral prompted conditional items the planning board incorporated, including prohibitions on direct stormwater discharge into state right-of-way without mitigation.
Board members said the DEC’s recent regulation changes mean the required wetland delineation may require additional mitigation and could “potentially impact some aspects of the site layout.” The planning board made that potential impact part of its approval: no building permit will be issued until the applicant completes the DEC process for jurisdictional wetlands and follows any DEC-directed avoidance, minimization or mitigation steps; if that process requires site-plan modifications the applicant must return to the planning board.
The approval lists additional conditions: completion of a sidewalk along Fly Road in accordance with NYSDOT plans, compliance with items listed by the county planning board, submission of cut sheets for lighting and coordination of drainage studies; the planning board incorporated by reference the full environmental assessment form and findings on file.
