The Park County Board of County Commissioners directed staff to prepare a resolution approving a conditional use permit Wednesday for an existing residence and a proposed garage in the Mining Zone District north of County Road 14 in Fairplay.
What happened: Planning staff presented the application by Robert Casola for a CUP to authorize a residential structure and a garage on a roughly 6.09-acre parcel at 1109 County Road 14. The Planning Commission held a public hearing and on April 17 voted unanimously to recommend approval without conditions. Planning staff briefed the Board on the approval criteria in Park County Land Use Regulations.
Key findings: Planning staff reported a geotechnical review (prepared by Dean Missentoni and included in the application packet) that found no evidence of historic surface or underground rock mining on the parcel and stated the potential for geological hazards related to historical mining is minimal. Staff also noted the property has frontage on County Road 14 and the applicant has applied for a driveway registration permit; the environmental health office will inspect any driveway improvements before a building permit is issued.
The applicant, Robert Casola, said he has worked with the Meadowland Area Land Trust (MALT) to modify an existing conservation easement so the proposed garage would not encroach on a drain field or conservation restrictions, and he said he would construct the garage using log-cabin-style materials to match local character. A contractor supporting the application, Ray Butler of RLB Builders, spoke in favor.
Action: The board voted 3-0 to direct staff to draft a resolution approving Conditional Use Permit Case No. 25-022 for Robert Casola with seven findings of fact that correspond to the land-use approval criteria.
Next steps: Staff will prepare the resolution for a future meeting; building permits and an approved driveway registration will be required prior to construction of the garage.
Public comment: No members of the public spoke in opposition during the hearing; one supporter testified in person and two Planning Commission public-comment letters were on file.
