ZBA permits larger West Falmouth house but requires denitrification and height certification

The Zoning Board of Appeals approved a special permit for Paul and Susan Broderick to raise and replace a house at 51 Namasket Road in West Falmouth, allowing lot coverage by structure to increase to 24.9 percent under the bylaw provision that permits greater coverage in an RB district by special permit.
Attorney Kevin Clauer, representing the Brodericks, said the existing 1965 house requires rebuilding to meet flood-zone elevation standards (VE 18). The proposal retains four bedrooms, upgrades the septic to a denitrification system that the Board of Health must approve, and will require water-service upgrades and an inside meter as requested by the water department.
The building height was close to the bylaw maximum; the building commissioner asked for a framing/stake height certification when the structure reaches the relevant stage. The Engineering Department recommended stormwater controls, including dry wells, for roof runoff. Clauer said the proposal is in character with the neighborhood and noted letters of support from neighbors.
The board recorded findings that the site and design are compatible with the neighborhood and that nitrogen impacts will be addressed by the required denitrification system. Conditions include compliance with plans on file, final Board of Health approvals for the septic, height certification for the building and verification of lot coverage prior to final occupancy.
The motion to approve passed by voice vote with no recorded opposition.
