The Ozark City Board of Aldermen enacted an ordinance approving an addendum to an intergovernmental agreement with Christian County that allows the city to issue a final plat and authorize building permits for lots in the Ozark Marketplace subdivision before completion of the public improvements, provided developer security (such as an irrevocable letter of credit) is placed and the county completes public improvements within one year or the city draws on the security.
City staff said the addendum permits concurrent construction of public infrastructure and private buildings, with the developer required to post security equal to the higher of the engineer’s estimate or the project bid to protect taxpayers. Staff and the county representative said the city will withhold final occupancy permits until public improvements are completed; the addendum gives the county one year to complete required improvements, with the city authorized to finish work using the security if the county fails to do so.
Mayor and aldermen enacted the measure as Ordinance 25‑022 after a motion by Alderman Galloway, seconded by Alderman Snyder. The roll call vote recorded six ayes: Aldermen Schneider, Campbell, Hutchinson, Galloway, Aiken and Metcalfe.
Why this matters: the addendum is a key procedural step in the Ozark Marketplace package that allows approved tenants to begin vertical construction sooner while preserving city remedies to complete public infrastructure if the county or developer fails to finish the work. By ordinance, occupancy permits will not be granted until public improvements are completed.
Ending: The ordinance passed 6–0. Staff said the county had requested an expedited schedule and that separate development, CID and Chapter 353 items would return to the board for later action.
