Planning Commission recommends rezoning at 100 Northeast Douglas to allow small office, 6-1 vote

The Lee's Summit Planning Commission voted 6-1 on March 27 to recommend rezoning 100 Northeast Douglas from R-1 NSO (neighborhood stabilization overlay) to the Transitional Neighborhood Zone (TNZ) and approved a preliminary development plan that would convert the existing single-family house to a small professional office and add a seven-stall parking lot with one ADA stall.
The recommendation came after a presentation by applicant representative Matt Slish of Engineering Solutions and a staff report from Senior Planner Adair Bright, who entered exhibits 1 through 15 into the record and said the site is inside the downtown activity center and that the TNZ is intended to provide a softer transition from the central business district to adjacent residential areas.
The application proposes to retain the existing building (constructed about 1902), rebuild a rear deck with an ADA lift, and construct an eight-stall parking area (shown in plans as seven standard stalls plus one ADA stall) accessed from Maple Street; the applicant and staff said landscaping and a detention basin to manage stormwater infiltration are included in the plan.
During public comment, resident Carol Matthews of 1 Northeast Douglas urged commissioners to consider how rezoning to TNZ would affect the neighborhood stabilization overlay in nearby historic sections and said many neighbors had not received mailed notice: "we apparently aren't in the area that would receive notification of an upcoming change," she told commissioners. Matthews and other residents expressed concern that piecemeal rezoning and additional parking lots could fragment a historic residential area.
A city staff member explained that the neighborhood stabilization overlay applies only to R-1 and focuses on bulk, scale and massing for new construction; staff said the TNZ contains specific language requiring compatibility in building design and character and therefore "gives us a little bit more control" and additional protections for keeping the existing residential form even if the use becomes an office.
Commission discussion touched on driveway access and a planned easement to be shown at replatting, fence or landscape screening along the rear property line, the material for the deck (five-quarter cedar decking shown in plans), the proposed stormwater infiltration basin, and whether the proposed use would generate evening activity; the property owner, David Thompson, described his business as a small financial services and investment-management firm operating weekdays roughly 8:30 a.m.โ5 p.m.
Commissioner Terry Trafton voted no; the motion to recommend approval passed with yes votes from Sherry Frazier, Jake Lovelace, Dana Arth, Chip Tazinski and Randy Benbrook (tally: 6 yes, 1 no). The staff and applicant said a replat and a dedication of a small easement at the Northeast corner (shown to be completed at platting) would be handled before building permits are issued.
The Planning Commission's recommendation will go to the City Council for final action.
